1. Who we are; acceptance
These Terms are an agreement between you and Coditive Kft., registered seat [REGISTERED_ADDRESS], company
registration number [COMPANY_REG_NO] ("we", "us"). They apply to the Famonda mobile app for iPhone, iPad and Android
and to the service behind it (together, the "Service"). There is no Famonda web app. By creating an account or using
the Service you accept these Terms and our Privacy Policy (https://famonda.com/<lang>/privacy). If you do not agree,
do not use the Service.
2. What Famonda is — important limits
Famonda is a family care organization and reminder tool.
- No medical advice. The Service does not provide medical advice, diagnosis or treatment and is not a medical device. What you see in the Service is information entered by you and your family. Always ask qualified health professionals for medical decisions, including doses.
- Reminders can be missed or late. Whether a reminder or alert arrives depends on your device settings and permissions, battery and power-saving settings, connectivity and on Apple and Google services. Do not rely on the Service as the only safeguard for medication or other critical care.
- Not an emergency service. The Service cannot contact emergency services, and missed check-in alerts are a reminder for your family, not an emergency response. In an emergency, call your local emergency number.
3. Eligibility; your account
You must be at least 18 years old and able to enter into a binding contract. Keep your sign-in details safe; you are responsible for activity under your account. Keep your information accurate.
A person you care for may use simple mode on their own device through a setup link from an admin of your family group; they need their own account. LAWYER: confirm the age and capacity rules for the person using simple mode.
4. Family groups, roles and information about others
The Service lets members share information inside a family group. Admins manage membership and roles (admin, caregiver, viewer). When you enter information about another person (for example the person you care for), you confirm that you are entitled to do so and that you have informed them where the law requires it. Leaving or being removed from a group ends your access to it; what you added stays in the group's history.
5. Your content; our licence to host it
You keep ownership of the content you add (profiles, notes, documents, voice notes and so on). You allow us to host, store, copy and transmit it only to provide and secure the Service for you and the members of your family group, as described in the Privacy Policy. You are responsible for having the rights to what you upload.
6. Acceptable use
Do not misuse or disrupt the Service; do not access other people's data without permission; do not upload unlawful content or content that infringes others' rights; do not use the Service to provide medical services; do not reverse engineer it except where the law allows; do not resell it; do not try to get around plan limits or security measures.
7. Free plan, Premium and billing
- Free plan. Free includes 1 family group you set up, 1 person you care for, 10 active medication reminders, 20 open tasks, 100 MB of document storage and 30 days of timeline history. Joining family groups and inviting members is free.
- Premium. An optional subscription for one family group, bought by an admin of that group; it covers every member of the group. Its limits and features are shown in the app before you buy.
- Billing by the app stores. Purchases in the iOS app are billed by Apple to your Apple Account; purchases in the Android app are billed by Google Play. The store's terms apply to payment, taxes and refunds.
- Automatic renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Manage or cancel in your App Store or Google Play subscription settings. Deleting the app or your account does not cancel a subscription.
- Price changes are announced in advance under the store's rules.
- Refunds are handled by the store under its policies, except where consumer law gives you rights directly against us.
- When Premium ends. Nothing you added is deleted. Existing medication reminders keep working. Free plan limits apply to new items (for example a new reminder above the limit or a new upload above 100 MB); timeline activity older than 30 days is hidden until Premium is active again; Premium features such as missed check-in alerts pause.
8. Availability and changes
We work to keep the Service available but do not guarantee uninterrupted operation. We may change features; we will give reasonable notice of material changes and will not materially reduce paid features during a paid period without a remedy where the law requires one.
9. Ending the agreement
You may stop using the Service and delete your account at any time in the app (Settings → Privacy & data → Delete
account) or as described at https://famonda.com/<lang>/support#delete-account. We may suspend or close accounts for a
serious breach of these Terms, with notice where practicable. Sections 5, 6, 10–13, 16 and 17 survive termination.
10. Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and uninterrupted operation. Nothing in these Terms limits rights you have under mandatory consumer law, including EU consumer protection.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential damages, loss of data, or losses caused by missed or late reminders or alerts (section 2). Our total liability is limited to the greater of the amounts you paid for the Service in the 12 months before the claim and EUR [50]. Nothing limits liability for intent, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be limited by law. LAWYER: align with Hungarian and EU mandatory rules.
12. Indemnity
To the extent permitted by consumer law, you will compensate us for third-party claims caused by your content or by your breach of sections 4 to 6.
13. Intellectual property; licence to use the app
The Service, the app and the Famonda brand belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your family's non-commercial use, under these Terms and the applicable app store rules.
14. Third-party services
The app stores, Sign in with Apple, Google sign-in and the calendar apps you choose to connect are third-party services under their own terms; we are not responsible for them.
15. Apple-specific terms (minimum EULA terms)
These Terms are between you and us, not Apple; Apple is not responsible for the app or its content. The licence in section 13 is limited to use on Apple devices you own or control as permitted by the App Store Terms (including Family Sharing where enabled). Apple has no obligation to provide maintenance or support. If the app fails to conform to a warranty, you may notify Apple for a refund of the purchase price; to the maximum extent permitted by law Apple has no other warranty obligation. Apple is not responsible for addressing claims relating to the app (including product liability, legal or regulatory non-conformity and consumer protection) or third-party intellectual property claims. You confirm that you are not located in an embargoed country and are not on a U.S. list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. LAWYER: keep in sync with Apple's current minimum terms.
16. Governing law; disputes
These Terms are governed by the laws of Hungary, without affecting the mandatory consumer protection of your country of residence (EU consumers keep their local protections and courts). LAWYER: confirm; add the EU ODR/ADR information that currently applies.
17. General; languages
If a provision is invalid, the rest remains in force. We will announce material changes to these Terms in the app before they take effect. These Terms are published in English, Hungarian, Turkish, Arabic, German, French and Spanish; the English version controls.
